Provider: Nibit AI, a sole proprietorship (eenmanszaak) registered in the Netherlands, with its business address at Staten Bolwerk 54, 2011 MN Haarlem, Netherlands. A sole proprietorship has no separate legal personality, so the party you contract with is the individual who owns the business and trades as Nibit AI. The Terms of Service say the same at their head.

1. Who this is for

You are reading this because someone aged 13 to 17 holds a Nibit account and a paid subscription is being set up for it. Nibit asks a parent or legal guardian to be the person who buys that subscription, and this document is what you agree to when you do.

It sits alongside the Terms of Service and the Privacy Policy rather than replacing them. Where this document and the Terms say different things about a subscription bought by a parent or guardian, this document governs.

If the account holder is 18 or over, none of this applies to them. They buy their own subscription under the Terms.

2. Why we ask an adult to buy

A Nibit account is free and open to anyone aged 13 or over. Paying for one is a different matter, because a subscription is a contract, and the law in each market we serve limits the contracts a minor can enter into.

  • The Netherlands and the EU. The age of majority is 18. A minor needs their legal representative's authorisation to enter a contract, and without it the contract can be annulled.
  • The United States. The age of majority is 18 in most states and higher in a few. A contract with a minor is voidable, which means the minor can walk away from it and reclaim what was paid.
  • India. A contract with a minor is void from the outset under the Indian Contract Act, not merely voidable. There is nothing to enforce, in either direction.

Asking you to be the purchaser answers all three at once. You are the customer, the contract is with you, and the account holder simply gets the paid features.

3. What you confirm when you subscribe

At the point of purchase, on the payment page, you confirm each of the following. We record what you confirmed and when.

  1. You are 18 years of age or over.
  2. You are the parent or legal guardian of the account holder, or you are otherwise lawfully authorised to act for them.
  3. You agree to the Terms of Service in your own name, as the person contracting for this subscription.
  4. You consent to the account holder continuing to use Nibit, and you have read the Privacy Policy.
  5. You are the person paying, using a payment method you are entitled to use.

You become the account's payer and the party we contract with. The account holder stays the account holder: the notes, files, and content are theirs, and the Terms continue to govern how they use the Services.

4. What we verify, and what we do not

We should be plain about this. We do not verify your identity, your age, or your relationship to the account holder. A general-purpose study app is not required to do so in any of the three markets, and we do not.

What the process does rely on is that completing a payment takes an adult's payment method. That is a meaningful check, and it is why the confirmations above are collected on the payment page rather than inside the app, where the account holder is the one signed in.

It is not a guarantee. If a young person completes a purchase with an adult's payment method and without permission, section 6 is how that gets put right.

5. What you take on

  • Payment. The subscription renews automatically until it is cancelled, and you are the person charged. Terms of Service section 8 covers renewal, price changes, failed payments, and cancellation.
  • Supervision. You consent to the account holder's continued use of the Services. What they write, import, share, and generate is theirs to decide, within the Acceptable Use Policy.
  • Telling us when things change. If you stop being the account holder's parent or guardian, or you no longer want responsibility for the subscription, cancel it or write to legal@nibit.ai.

6. Cancelling, withdrawing, and getting money back

These rights are yours rather than the account holder's, because the contract is yours.

  • Cancel at any time. Cancellation takes effect at the end of the period already paid for. See Terms of Service section 8.
  • Withdraw within 14 days. If you are a consumer in the EU or the EEA you have 14 days from the day the subscription starts to withdraw from it, without giving a reason. Terms of Service section 8.1 explains how and includes a model form.
  • A purchase you did not authorise. If a subscription was bought on your payment method without your permission, write to legal@nibit.ai with "Unauthorised purchase" in the subject line. We will cancel it and refund the payments we received. We will not ask you to prove the relationship first, and there is no retention flow to sit through.

You can withdraw the consent in section 3 at any time by writing to legal@nibit.ai. Withdrawing it cancels the subscription. It does not delete the account or its contents, which belong to the account holder. If you want the account itself reviewed, corrected, or deleted, section 8 is the route.

8. Your rights over the account holder's information

As the parent or legal guardian of a user under 18, you can ask us to show you what we hold about them, correct it, or delete the account entirely. Write to privacy@nibit.ai from an address we can verify against the account. We will act on it, and we will not ask you for a court order first. Privacy Policy section 14 says the same and sets out how we treat users under 18 generally.

9. Information we collect about you

Becoming the payer means we hold some information about you, not only about the account holder:

  • your name and billing address as given to our payment provider, and the country you are billing from;
  • the email address you give us for receipts and billing notices;
  • a record of the confirmations in section 3: which ones you gave, the version of this document you saw, the date and time, and the IP address they came from; and
  • payment records, which tax law requires us to keep for seven years.

We do not receive or store your full card details. The Privacy Policy governs all of this, and the payment provider is named in the Subprocessors list.

10. India

The Digital Personal Data Protection Act treats everyone under 18 as a child and requires verifiable consent from a parent or legal guardian. The confirmations in section 3 are consent, but the Act sets a higher standard of verifiability than a confirmation given at a payment page.

To completethe verifiable guardian-consent mechanism for India, which has to be in place before the Act's provisions on children are relied on for Indian users. Until it is, a purchase for an account holder under 18 in India rests on the refund undertaking in section 6 rather than on a compliant consent record.

11. Changes

We may update this document. Where a change is material we will say so and give notice before it takes effect, and the version you agreed to stays reachable at its own dated URL. Privacy Policy section 15 explains how archived versions work.
